Where can I use my Gift Card?

You can use your Gift Card in almost 200 participating Mildura City Heart businesses. Browse the store list here or check the business details on the Mildura City Heart Business Directory.

How can I use my Gift Card?

Gift Cards are available in physical format, and can be redeemed in-store at participating Mildura City Heart business’ EFTPOS terminal.

Gift cards issued come with a custom expiry date. Gift Cards issued before 1 November 2019 have a 12-month expiry date. Gift Cards issued after 1 November 2019 have a 36-month expiry date.

You can arrange to collect the Physical Gift Card free of charge from the Mildura City Heart office at 63a Langtree Mall, Mildura. Photo identification for receipt of the Gift Card is required. If you are sending someone else to collect your gift card purchase, you will need to advise Mildura City Heart staff who will be collecting it and advise the person collecting the gift card that they will be required to show photo identification.

Before I buy a Gift Card, will I need to register or sign up?

No, you don’t have to create an account to purchase a Gift Card from https://staging.milduracityheart.com.au/gift-card/.

However, creating an account will help you track your order status, as well as speed up your future shopping experience by saving your address details, order history and faster re-order capability. Create an account quickly and easily when you make your order here.

Will I receive a notification when I buy a Gift Card online?

When you purchase a Physical Gift Card, you’ll receive the following notifications:

A confirmation email will be sent to the email address used to make the purchase advising the order was successful.

 

A separate Tax Invoice will be sent to the email address used to make the purchase of the Gift Card.

 

All correspondence regarding gift cards, offers, promotions or reminders are directly sent from the following email address admin@milduracityheart.com.au If you haven’t received your confirmation email or tax invoice, please give us a call on (03) 5023 8010.

Will I be sent a tax invoice for my online Gift Card purchase?

When you purchase a Gift Card, a tax invoice will be sent to the email address used to make the purchase of the Gift Card. Gift Card order limits

There is no limit to the number of Gift Cards you can buy at a Participating Store, if the Physical Gift Card is in stock. If you have a large order, you will be directed to make the transaction with the Mildura City Heart office team.

 

Gift Card loads are limited to a minimum value of $25 and a maximum value of $1,000 per card. The total order value of all cards issued is limited to a purchase of up to $10,000. Any large volumes are encouraged by contacting our team.

What happens if my payment didn't go through?

If your payment did not go through, please check your bank account to confirm the payment has not been processed. You can go back to place your order using another credit or debit card.

I want to donate my MCH gift card, how do I do this?

If you are no longer able to use your Gift Card by the expiry date, you can opt to donate the card to support a local school fundraiser, community event, or charity event that Mildura City Heart is approached to support. 

 

To do this you can bring your gift card to the MCH office at 63a Langtree Mall. If you no longer have the card but would like to donate it, MCH staff can go through the process of retrieving it for your donation.

These Terms and Conditions are important, and you should read them fully. However, there are some specific terms we wanted to make you aware of. These are set out below. These do not affect your rights under the Australian Consumer Law (ACL).

  • Minimum and maximum amounts that can be loaded on a Mildura City Heart Gift Card may be changed at any time as required by law. If we do so, we’ll give you notice via the Mildura City Heart website (see clause 5.5 for more details).
  • Without excluding, restricting, or modifying your rights under the Australian Consumer Law (and any other non-excludable statutory right) our liability to you in all other cases will be limited to refund or reissue of your Mildura City Heart Gift Card up to the value of your purchase. We will not be liable for indirect or consequential loss arising from or connected to your Mildura City Heart Gift Card and our liability to you for loss or damage related to or in connection with your Mildura City Heart Gift Card will be reduced to the extent you cause or contribute to the loss or damage (see clauses 11.2, 11.3 and 11.4 for more details).
  • The resale, marketing, advertising, or other promotional activities related to or of a Mildura City Heart Gift Card is strictly prohibited without our prior written consent. If you do so without prior written consent of Mildura City Heart your Gift Card may be considered invalid and we are not obliged to allow the recipients to use or redeem the Card Balance on these Mildura City Heart Gift Cards (see clauses 6.7 and 12.1 for more details).

TERMS & CONDITIONS

1. Definitions

Terms and Conditions means the Terms & Conditions by which you are legally bound.

Activate defines the initial loading of value onto a Mildura City Heart Gift Card.

Card Balance is the unspent value of a Mildura City Heart Gift Card.

Card Number means the 19-digit number appearing on the back of Physical Gift Card.

Dispatch Date is the date the Mildura City Heart Card was mailed to the Recipient of the Gift Card.

Expiry Date means

  • a) for Mildura City Heart Gift Card purchased before 1 November 2019, the date being 12 months from the date of purchase of the Physical Gift Card, after which any remaining funds on a Mildura City Heart Gift Card will not be available for Redemption.
  • b) for Mildura City Heart Gift Card purchased on or after 1 November 2019, the date being 36 months (three years) from the date of purchase of the Physical Gift Card, after which any remaining funds on a Mildura City Heart Gift Card will not be available for redemption as required by law. All remaining funds after this date shall be considered forfeited.

Gift Card means Physical Mildura City Heart Gift Card issued in conventional plastic form.

Mildura City Heart means the Mildura City Heart Traders Association authorized to issue the Physical Gift Card.

Mildura City Heart Gift Card means the Gift Card issued by us to you as a Physical Gift Card. Also referred to as ‘Gift Card’.

Participating Store means any participating stores listed on the Website which accepts payments using the Mildura City Heart Gift Card, as amended sometimes for currency. Please see Mildura City Heart website for full and up-to-date details.

Physical Gift Card means Mildura City Heart Gift Card issued in conventional plastic form. Also referred to as ‘Mildura City Heart Gift Card’ and ‘Gift Card’.

PIN is the 4-digit number on the back of a Mildura City Heart Gift Card which is required to make a transaction or transaction enquiry.

Recipient means the person who receives the Mildura City Heart Gift Card as the case may be (and for the avoidance of doubt may be the same as the purchaser and/or receiver).

Redeem means to use in-full, wholly or in-part reduce the initial or entire value issued on the Mildura City Heart Gift Card by using the Mildura City Heart Gift Card to purchase goods or services, and Redeemable, Redeemed and Redemption have corresponding meanings.

Website is defined as www.milduracityheart.com.au

Any reference to we, us or our is in reference to Mildura City Heart Inc and our distributors.

A reference to you or your is a reference to the person who agrees to these Terms and Conditions under Clause 2 as required to comply with and in complete agreement to act under these Terms & Conditions as prescribed by law.

2. Agreeing to the Terms and Conditions

  • 2.1 These terms and conditions apply to each Mildura City Heart Gift Card issued.
  • 2.2 As purchaser or recipient, you solemnly agree and are bound by these Terms and Conditions by purchasing, activating, using, or attempting to use a Gift Card, or by making a transaction enquiry or exercising any right to Redeem value loaded on a Gift Card.
  • 2.3 By purchasing, using or attempting to use a Gift Card, or by making a transactions enquiry or exercising any right to Redeem value loaded on a Gift Card, you warrant to us that you will comply with these Terms and Conditions and all applicable laws and that the Gift Card will not be used in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers or any other parties known or otherwise as prescribed by law.
  • 2.4 If you are giving a Gift Card to another person, you should ensure that they are aware of the Terms and Conditions that apply to the Gift Card and the relevant Expiry Date of the Gift Card as defined as a maximum of three (3) Years from date of issue.

3. Purchasing a Mildura City Heart Gift Card

  • 3.1 Gift Cards can be purchased from these Participating Stores:
    1. Mildura City Heart office, 63a Langtree Mall, Mildura;
    2. Surf Crew, 59 Langtree Mall, Mildura;
    3. Banjo’s Café Bakery, cnr Langtree Mall and Ninth Street, Mildura; and
    4. Mildura Visitor Information Centre, cnr Deakin Avenue and Twelfth Street, Mildura.
  • 3.2 Physical Gift Cards can be purchased online at the Website https://staging.milduracityheart.com.au/gift-card/
  • 3.3 Physical Gift Cards can be purchased by direct debit on request of an invoice by calling (03) 5023 8010 or emailing admin@milduracityheart.com.au
  • 3.4 When purchasing Gift Cards at any Participating Store, payment can be made via debit or credit card, excluding American Express, Salary Packaging cards such as Meal Entertainment cards.
  • 3.5 The Gift Card is loaded using the EFTOPS terminal, therefore the payment must be made using a debit or credit card. Cash is not accepted as form of payment due to the cashless process of loading the Gift Card using the EFTPOS Terminal for each issued Gift Card. Once payment has been taken, the payment amount is ‘refunded’ onto the Physical Gift Card.
  • 3.6 When purchasing Physical Gift Cards online, payment can be made using a debit or credit card (excluding American Express, Salary Packaging cards such as Meal Entertainment cards), or via PayPal. Payment is required (including payment clearance) prior to the Gift Card being issued or dispatched.
  • 3.7 When purchasing Physical Gift Cards, payment can be made using direct debit. Payment is required (including payment clearance) prior to the Gift Card being issued or dispatched.
  • 3.8 When purchasing a Gift Card, you agree to give your Explicit Informed Consent (EIC) as outlined to supply the personal contact details of the purchaser and the recipient. This information is for Mildura City Heart staff only and is not given or sold to third parties and is protected under Privacy Laws and governed by the Office of the Australian Information Commissioner (OAIC). If you do not agree to these Terms you are entitled to Opt-Out of EIC and such protections that may apply as set out under the Terms and Conditions as prescribed. EIC Consent if freely given is assumed for the life of the Term of the active life of the gift card (36 months from date of issue).
  • 3.9 Mildura City Heart holds and accesses personal contact details if a Physical Gift Card is lost, stolen or nearing expiry to fulfil the Gift Card as issued. By agreement to these Terms, you may be contacted by Email, Phone or SMS in relation to fulfillment, relevant offers and advertising or any other reason as outlined in the Terms and Conditions.

4. Personalising a Mildura City Heart Gift Card Online Order

  • 4.1 The Mildura City Heart Gift Card comes in 6 branded colour variations, and the Mildura City Heart Gift Card Holder comes in 3 branded colour variations. When purchasing a Gift Card, the colour of Gift Card and the Holder is random, not available for selection and not able to be returned or exchanged for another colour.
  • 4.2 There is no additional cost to you to personalise a Gift Card.
  • 4.3 To personalise the Gift Card, the procedures set out on the Website when ordering a Gift Card must be followed. You have the choice to:
    1. Provide a personal message; or
    2. Not provide a personal message.
  • 4.4 If we find inappropriate, offensive, or otherwise objectionable messages, we reserve the right to remove the offending message and apply a default message to the Gift Card Holder. Offending material includes, but is not limited to:
    1. Patently offensive material that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual;
    2. Copyrighted or trademarked material not owned by you;
    3. Abusive, threatening, obscene, defamatory, or libelous statements or imagery;
    4. Political or religious imagery which is offensive to cultural values;
    5. Pornographic or sexually explicit material of any kind; and
    6. Advertising or promotional materials or branded products.
  • 4.5 By accepting this offer, you agree to indemnify us against any claim, damages, or expenses we suffer in connection with the message.

5. Loading Values & Limitations – Mildura City Heart Gift Card

  • 5.1 A minimum of $25 and a maximum of $1,000 can be loaded on each Physical Gift Card:
    1. in a Participating Store, at the point of sale via EFTPOS.
    2. online at the Website via debit card, credit card, or PayPal.
    3. at the Mildura City Heart office, via direct debit on request and receipt of an invoice from Mildura City Heart Inc.
  • 5.2 A maximum of up to 10 gift cards may be issued in any one transaction up to a total of $10,000, not exceeding $1000.00 each at time of issue.
  • 5.3 At our absolute discretion, we may change the minimum and maximum amounts that can be loaded on Gift Cards. If we decide to do this, we will publish details on our Website.
  • 5.4 The Gift Card is not reloadable.
  • 5.5 Your Gift Card is valid for use until the Expiry Date as displayed on the Gift Card.

6. Redeeming your Mildura City Heart Gift Card

  • 6.1 Your Gift Card can be Redeemed for goods and services from Participating Mildura City Heart Stores up to the value loaded onto your Gift Card. Value Redeemed is deducted from the Card Balance.
  • 6.2 The Mildura City Heart Gift Card is a Physical item and must be swiped through an EFTPOS terminal to Redeem for goods and services from Participating Stores. The Gift Card cannot be tapped or inserted.
  • 6.3 Gift Cards cannot be used for online purchases, or on SQUARE or Shopify terminals in Australia.
  • 6.4 It is assumed you do not use your Gift Card to purchase:
    1. Gift Cards and Vouchers;
    2. Lotto / Lottery products; or
    3. Donations or charity products (such as merchandise).
  • 6.5 Gift Cards cannot be refunded or used to obtain cash. You cannot use your Mildura City Heart Gift Card to make a credit card payment or other transaction payments.
  • 6.6 Every effort is made to ensure ease of use of the Gift Card at listed participating stores. If the card cannot be redeemed at the time of use, Mildura City Heart Inc aims to resolve it as soon as possible after attempted use within two (2) Business days (Excluding Public holidays). Examples of when this might happen include internet outage, balance less than attempted redemption, faulty card, EFTPOS terminal issue, system, or human error.
  • 6.7 Resale of Mildura City Heart Gift Cards is strictly prohibited, except with our prior written consent. Gift Cards that are resold in breach of this clause 6.6 may be considered invalid and we are not obliged to allow the Recipients of those cards to use or Redeem unspent value on their Gift Cards.
  • 6.8 If the gift card holder is not able to redeem the Physical Gift Card for goods and services with a participating business, the holder is able to donate the remaining value of the Gift Card back to Mildura City Heart for the purpose of supporting local charities, fundraisers, or community events. Mildura City Heart has a sponsorship and donation program. The holder is unable to make direct requests for donation recipient. The holder can view a list of previous and current recipients of the donation program in our Annual Report, available on our website.

7. No Recharging of the Mildura City Heart Gift Card

  • 7.1 Your use of the Gift Card at a Participating Mildura City Heart Store is always subject to the policies (and, where applicable, other terms and conditions) of that Participating Store regarding the goods and services made available by it. For example, if you are under the age of 16 years, your Gift Card cannot be Redeemed for products such as knives or, if you are under 15 years, a Participating Store may not supply you with video games or other material classified as MA15+.
  • 7.2 Where the price of the goods or services being purchased with the Gift Card exceeds the Card Balance, you must pay the amount in excess of the Card Balance by an alternative payment method at the discretion of the relevant Participating Store, using a split payment method.
  • 7.3 Once your Gift Card has reached its Expiry Date, any unspent value cannot be used or Redeemed by you or its recipient.
  • 7.4 Once your Mildura City Heart Gift Card has reached a nil balance it cannot be reloaded or reactivated.
  • 7.5 The Redemption of Gift Cards is restricted to the purchase of standard retail quantities of goods.
  • 7.6 After a Gift Card has been loaded you cannot subsequently add value to it.

8. Transaction Enquiries

  • 8.1 You can check your Gift Card transaction history and Card Balance by:
    1. Visiting the Website at https://staging.milduracityheart.com.au/gift-card/; or
    2. Calling the office on (03) 5023 8010.
  • 8.2 To make a balance enquiry on your Gift Card as set out in clause 8.1, you must provide your Card Number and PIN when prompted.

9. Lost or Stolen Mildura City Heart Gift Cards

  • NOTE: You must treat your Gift Card like cash. If your Gift Card is damaged, lost or stolen, please contact us by calling (03) 5023 8010.
  • 9.1 We reserve the right to place a stop on your Gift Card if:
    1. a) You report that your Gift Card has been lost, stolen, or damaged;
    2. We believe (or reasonably suspect) that you have used (or will use) your Gift Card contrary to these Terms and Conditions; or
    3. We believe (or reasonably suspect) that there is an error with your Gift Card.
  • 9.2 If your Gift Card has been lost or stolen, Mildura City Heart can apply to have the funds transferred onto a new physical card. If approved by the issuing card company, the process can take up to ten (10) working days.
  • 9.3 The issue of a replacement physical gift card will incur a $5 administration fee, payable to Mildura City Heart Inc. We will notify you to collect the replacement Physical Gift Card from the Mildura City Heart office at 63a Langtree Mall, Mildura.
  • 9.4 If the lost gift card is being donated on by the holder, no administration fee will be incurred.

10. Communications from and with Mildura City Heart

  • NOTE: The Mildura City Heart Gift Card is an integral program of the Shop Local policy and promotion programming, and Mildura City Heart Inc is committed to ensuring all gift cards purchased are spent prior to the expiry date to ensure funds collected by the program stay local.
  • 10.1 Mildura City Heart collects contact details for the purchaser and the recipient at the point of sale for communication about the gift card. Mildura City Heart will endeavour to contact you a minimum of three times across the lifespan of the gift card as a courtesy reminder to redeem its full value with local businesses as listed on our website.

11. Liability

  • 11.1 You are responsible for the security, use and safety of your Gift Card. Please be careful of scams and note we do not take any responsibility where you give access to your Gift Card to a third party in a manner that is not in accordance with these Terms and Conditions.
  • 11.2 Without excluding, restricting, or modifying the rights and remedies to which you may be entitled under the consumer guarantees provisions of the Australian Consumer Law (and any other non-excludable statutory right) our liability to you in all other cases will be limited to refund or reissue of your Gift Card up to the value of your purchase.
  • 11.3 We will not be liable to you for indirect and consequential loss arising from or connected to these terms and conditions or your Gift Card in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or willful misconduct.
  • 11.4 Our liability to you for loss or damage of any kind arising out of or in connection with these terms and conditions or your Gift Card is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.

12. Relationship with us

  • 12.1 Mildura City Heart Gift Cards may be used as personal or business gifts but must not be used in connection with any marketing, advertising, or other promotional activities (including without limitations to websites, internet advertisements, email, telemarketing, direct mail, newspapers and magazine advertisements, and radio and television broadcasts) unless you obtain prior written approval from Mildura City Heart Inc. Mildura City Heart Gift Cards that are used in marketing, advertising, or other promotional activities in breach of this clause 12.1 may be considered invalid and we are not obliged to allow the Recipients of those cards to use or Redeem unspent value on their Gift Cards.
  • 12.2 Use of our name or brands, or any names, logos, or marketing material of Mildura City Heart Gift Cards (other than in connection with the purchase or use of our Gift Cards), is strictly prohibited.
  • 12.3 You must not use a Mildura City Heart Gift Card in any manner that states or implies that any person, website, business or product or service is endorsed or sponsored by or otherwise affiliated with us or any of our subsidiaries or affiliates.
